However, there are exceptions - only three states, Texas, Wyoming, and Mississippi, explicitly require lien waivers to be notarized to effectively release the owner from filed lien claims. Of these states, only Texas' law is explicit on the matter. Mississippi also allows for the recording of an Affidavit of Nonpayment to reinstate rights when a waiver is given but payment is not received.
